WASHINGTON – Mike Davis, founder and president of the Article III Project, issued the following statement after the Senate voted to confirm Eric Tung to the 9th Circuit Court of Appeals.

“Eric Tung’s confirmation marks another seismic victory for President Trump’s judicial legacy and for every American who believes in the rule of law, not the rule of politics. President Trump promised to nominate judges who interpret the law as written and defend the Constitution without fear or favor, and with Judge Tung’s confirmation, he continues to deliver.

“Judge Tung is the epitome of excellence and integrity. A graduate of Yale University and the University of Chicago Law School, where he served as Managing Editor of the Law Review, Tung went on to clerk for two of America’s greatest jurists: Justice Antonin Scalia and Justice Neil Gorsuch. He then built an extraordinary record as a federal prosecutor, a senior attorney at the Department of Justice, and a leading appellate litigator at Jones Day.

“Judge Tung’s confirmation is especially significant for the Ninth Circuit, which is dominated by activist judges who legislate from the bench. The Article III Project (A3P) was founded by veteran GOP operative and attorney Mike Davis, who, after helping win the Senate confirmation battles of Neil Gorsuch and Brett Kavanaugh, developed the reputation as a “take-no-prisoners conservative eager to challenge the left with hardball tactics,” as reported in The New York Times.‍‍

‍A3P defends constitutionalist judges, punches back on radical assaults on judicial independence (like court-packing) and opposes judicial and other nominees who are outside of the mainstream. Davis previously served as Chief Counsel for Nominations to Chairman Chuck Grassley (R-Iowa) on the United States Senate Committee on the Judiciary and led the Senate confirmation of Justice Brett Kavanaugh and a record number of circuit court judges.
