WASHINGTON — Mike Davis, founder and president of the Article III Project, issued the following statement after President Trump nominated Justin Smith to fill the vacant spot on the U.S. Court of Appeals for the Eighth Circuit.

His nomination of Justin Smith to the U.S. Court of Appeals for the Eighth Circuit is another step toward cementing a constitutionalist judiciary.
“Justin Smith is a proven legal warrior. He stood on the front lines of the monumental presidential immunity case alongside John Sauer on President Trump’s defense team, helping secure a historic victory for the presidency and the separation of powers. He sharpened his legal skills in the Missouri Attorney General’s Office under now-Senator Eric Schmitt, where he built a record of fighting and winning on the issues that matter most to the American people.
“Smith is a relentless advocate for protecting children and women’s sports, defending the sanctity of life, taking on woke ESG cartels, challenging unlawful COVID mask mandates, suing Communist China over COVID, and safeguarding election integrity. The Article III Project (A3P) was founded by veteran GOP operative and attorney Mike Davis, who, after helping win the Senate confirmation battles of Neil Gorsuch and Brett Kavanaugh, developed the reputation as a “take-no-prisoners conservative eager to challenge the left with hardball tactics,” as reported in The New York Times.
A3P defends constitutionalist judges, punches back on radical assaults on judicial independence (like court-packing) and opposes judicial and other nominees who are outside of the mainstream. Davis previously served as Chief Counsel for Nominations to Chairman Chuck Grassley (R-Iowa) on the United States Senate Committee on the Judiciary and led the Senate confirmation of Justice Brett Kavanaugh and a record number of circuit court judges.
