The Article III Project (A3P) is jumping in to defend one of President Donald Trump’s former Department of Justice (DOJ) appointees who has been a target of politically motivated lawfare, according to an amicus brief obtained exclusively by the Daily Caller.
The brief comes after the D.C. Bar Board on Professional Responsibility recommended disbarring former Assistant Attorney General Jeffrey Clark in 2025 over legal advice he offered surrounding the 2020 election. The board said Clark should be disbarred “as a consequence and to send a message to the rest of the Bar and to the public that this behavior will not be tolerated.”
Notably, Clark’s 2020 election memo was internal and not acted upon.
The Trump DOJ filed a complaint in response to the D.C. Bar’s actions, alleging the “improper use of bar discipline to regulate the official actions of Federal Government attorneys,” and citing concerns of government weaponization. A3P echoed concerns that the bar was weaponizing the legal system against Clark for political reasons.
“Leftwing Democrat activists are attempting to weaponize state bar rules for a partisan lawfare campaign against Article II officials,” Mike Davis, who founded the organization, told the Caller. “Trying to disbar federal attorneys over internal, pre-decisional legal advice is unconstitutional and an assault on the Supremacy Clause.”
“It cannot stand, and it will not stand.”
